Terms of service

01 // The show

Diva Clash™ (“the service”, “we”, “us”) is a music video party game: one screen plays videos, everyone else scores them from their phones. By opening a room, joining one, or otherwise using the service you agree to these terms. If you don't agree, don't use the service.

The service is provided free of charge. We may change, suspend, or discontinue any part of it at any time, including these terms — material changes will be posted on this page with a new effective date, and continuing to use the service after that means you accept the updated terms.

02 // YouTube runs the tape deck

Diva Clash uses YouTube API Services to search for videos and to play them in YouTube's embedded player. By using Diva Clash you agree to be bound by the YouTube Terms of Service. Google's handling of data in connection with the player and API is described in the Google Privacy Policy.

We don't host, upload, store, or modify any videos. Every video belongs to its owner and streams directly from YouTube; whether a video exists, is embeddable, or is available in your region is between YouTube and its rights holders. Diva Clash is not affiliated with, sponsored by, or endorsed by YouTube or Google.

03 // Your name, your picks

What you bring to a room — a display name and the videos you pick — must be yours to submit and lawful to show. No names or picks that are hateful, harassing, sexually exploitative of minors, or that impersonate someone else. You grant us a limited, non-exclusive license to display that content to the room and in the night's recap for as long as those exist, which is all we use it for.

Hosts run their rooms and are responsible for what plays in front of their crowd. We may remove content, end sessions, or block access at our discretion if something breaks these terms.

04 // House rules

• →Don't interfere with the service — no flooding rooms, probing, scraping, or hammering the API.
• →Don't try to break into sessions you weren't invited to, or pose as a room's host.
• →Don't reverse engineer or copy the service except where the law says we can't stop you.
• →Don't use the service for anything unlawful.

05 // Age

You must be at least 13 years old (or older where local law requires, e.g. 16 in parts of the EEA) to use the service, and if you're under 18 you need a parent or guardian's permission. Music videos on YouTube can carry mature themes — hosts choose what plays.

06 // Our stage, our marks

The service — its design, code, copy, and branding — belongs to us and is protected by intellectual property laws. DIVA CLASH™ and the Diva Clash wordmark are our trademarks; don't use them in a way that suggests we made or endorsed something we didn't. If you send us feedback or ideas, we can use them without owing you anything — thank you, by the way.

07 // Copyright complaints

Because videos live on YouTube, takedowns of the videos themselves go through YouTube's copyright process. If a Diva Clash recap page lists something you hold rights to and want removed, email egrada.tech@gmail.com with the recap link and we'll handle it promptly.

08 // Ephemeral by design

Live rooms expire roughly 12 hours after they open and recap pages roughly 30 days after the night ends. We have no obligation to retain, back up, or recover any session data — don't use the service to store anything you care about keeping.

09 // As-is, glitter included

The service is provided “as is” and “as available”, without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We don't promise the service will be uninterrupted, error-free, or that any video will play when the room is watching.

10 // Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or bragging rights, arising out of your use of the service. Our total liability for any claim relating to the service is limited to the greater of what you paid us to use it (zero dollars) and USD $10. Some jurisdictions don't allow certain limitations, so parts of this may not apply to you.

11 // Indemnity

If your use of the service, your content, or your violation of these terms gets us sued, you agree to defend and indemnify us against those claims, including reasonable legal fees.

12 // Housekeeping

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. If any part of these terms is found unenforceable, the rest stays in effect. These terms plus the privacy policy are the whole agreement between you and us about the service.
